Terms for the processing of data
via OpenAI API
1. Definitions of terms
The following terms are used in these terms and conditions and serve the purpose of clarification and uniform interpretation.
- LeanScope AI: The licensor's software, a platform for product discovery and user insights management.
- Licensor: LeanScope GmbH, Krayenkamp 10-11, 20459 Hamburg, Germany, is the provider of the software "LeanScope AI" in various versions.
- Licensee: The natural or legal person (client or customer) who uses or plans to use the "LeanScope AI" software in accordance with the licensor's terms of use.
- API (Application Programming Interface): A programming interface that enables software systems to communicate with each other.
- LLM (Large Language Model): A generative AI model that processes natural language and generates answers.
- GPT (Generative Pre-trained Transformer): is a special type of neural network that specializes in Natural Language Processing (NLP).
2. Background and purpose
The licensee would like to use LeanScope AI for its company. Among other things, LeanScope AI offers the option of generating virtual personas with the help of artificial intelligence (AI) and then using these virtual personas to discover and discuss the client's product requirements. To do this, LeanScope AI uses APIs from OpenAI and also transmits data to OpenAI.
3. Parties involved
The following parties are involved:
- The licensee
- The licensor
- Centigrade - as a full-stack service provider is a sales and development partner of LeanScope GmbH and takes over services such as development, hosting or data import if required.

4. Data transfer
The Licensee enters selected data (hereinafter referred to as "Data") into LeanScope AI. When using AI functions, LeanScope AI transfers this data to OpenAI exclusively by using the OpenAI API. OpenAI generates results and sends this data back to LeanScope AI.
5. Data protection and information security
The Licensee is responsible for ensuring that the data is free of personal data (e.g. names, e-mail addresses, IP addresses, etc. of actually existing persons). In addition, the Licensee is responsible for ensuring that the data is subject to the Licensee's information security classification, which allows it to be passed on to third parties (LeanScope AI, Centigrade and OpenAI) and processed there. The licensor and Centigrade do not pass on the data to other third parties.
According to OpenAI's terms of use, data transmitted via the OpenAI API interface is neither published nor used as training data for OpenAI's own services.

6. Type of data
It is intended to use data that is free of personal data and complies with an information security classification of the licensee that corresponds to the previous sections. The Licensor accepts no liability if the Licensee has not complied with its data protection and information security obligations and supplies data that should not have been processed or passed on in the manner described.
Data types: For example, publicly accessible manuals, white papers and other hardware or software information are conceivable, but ultimately anything that the licensee deems useful and supplies.
The licensor does not check this data and assumes that it is appropriate in terms of data protection and information security.
Note: To avoid processing personal data, it is advisable to anonymize the data before delivery so that, for example, no clear names or e-mail addresses are present in the data.
7. Revocation
Consent to the transfer of data to the OpenAI API can be revoked at any time for the future (e.g. by e-mail to contact@leanscope.ai) and will be prevented by the licensor from this point in time; however, this will affect the AI functionalities of LeanScope AI, which will then no longer be available.
The licensor has no influence on the processing by OpenAI of the data sent to OpenAI up to that point. OpenAI assures (as of 01/2025) that it will not process the customer data for its own purposes. Should OpenAI change this after compliance with the consent, the licensor has no influence on this. The Licensor shall regularly review the GTC and data protection provisions of OpenAI and take the necessary action in the event of changes.
